PoolStore.com Terms of Sale, Shipping, Returns, and Website Use Policy

1. General Terms, Warranties, and Taxes

  • Acceptance: By placing an order with PoolStore.com, you agree to these terms and conditions. We reserve the right to refuse service to anyone.
  • Pricing Errors: In the event a product is listed at an incorrect price due to a typographical or system error, PoolStore.com reserves the right to refuse or cancel any orders placed for that product, whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged, we will issue a full credit in the amount of the incorrect charge.
  • Warranties and Defective Products: All warranty claims are subject to the manufacturer's warranty. Product warranties are held strictly by the manufacturer of the product and not by PoolStore.com. We may assist the customer in working with the manufacturer in some cases with valid warranty claims, but all final warranties are subject to the manufacturer's discretion and approval. If the manufacturer requires the product to be shipped in for inspection, the customer is responsible for the return shipping costs, as well as the shipping costs for the warranty replacement.
  • Voided Warranties: Modifying an item from its original condition or using a product for something other than its intended use will void the warranty.
  • International Warranties: Items shipped outside the United States may not be covered under warranty; please contact the manufacturer for details.
  • Taxes: Sales tax will be collected where required by applicable law. Customers remain responsible for any applicable use taxes or similar taxes imposed by their local jurisdiction.

2. Shipping Logistics and Address Accuracy We make every effort to ship, or to have shipped, all items as quickly as possible.

  • Carrier Details: Most items ship FedEx or UPS Ground/Home (but this may vary based on the manufacturer and/or carrier cost and availability), and shipping charges will be determined based on your delivery location provided at checkout. Carriers charge shipping based on item packaging dimensions and not exclusively by weight; this applies to Lomart and Embassy pool parts and pumps as well as other products.
  • Excluded Addresses: We do not ship to P.O. Boxes, Military APO/FPO addresses, or freight forwarders. Customers must provide a valid physical delivery address.
  • International Orders: International orders may or may not be available, depending on the product. Freight quoted on an international order only covers freight and does NOT include any taxes, tariffs, duties, customs fees, or other fees imposed by the destination country.
  • Freight (LTL) Delivery Limits: Large or heavy items are shipped via Less-Than-Truckload (LTL) common carrier. Freight deliveries are strictly limited to curbside delivery only; trucking companies will not enter private property or transport products to your backyard.
  • Refused Deliveries & Storage Fees: If a customer orders a product and refuses delivery or does not pick up said product at the destination designated, the customer shall be liable for any resulting taxes, storage charges, duties, and return shipping fees. Items shipped via Common Carrier Truck (freight) will be charged a $250.00 flat fee for the return shipping of a refused shipment. A restocking fee of 15% to 50% will also apply.

3. Delivery Inspection, Bill of Lading, and Damage Claims

  • Inspection Upon Delivery: Customers are responsible for inspecting all products immediately upon receipt. Any damage, defects, or discrepancies must be reported prior to installation or use. If for any reason customers suspect there may be damage to the product and/or if they see damage to the packaging, they should take photographs prior to opening the package to show the state it was delivered in as well as photographs of the product. If it is clear that the product is damaged upon delivery, customers should not open the product and should call 1-800-918-POOL or email [email protected] for instructions.
  • Concealed Damage: Any concealed damage must be reported to PoolStore.com within 72 hours. You must retain all damaged items and original shipping cartons for the carrier's investigation. Do not attempt to install or use an item you suspect is damaged.
  • Claims for Defective Products: Photos are required with claims but are not a substitute for the original product. When placing a claim, defective products should be kept until the claim has been resolved and PoolStore.com or the manufacturer tells you to discard them.

4. Cancellations, Returns, and Chargebacks No returns, exchanges, or credits are allowed after 30 days from the original date of shipment. Products must be received in their original, undamaged carton in new, resaleable condition. Products that have been installed, assembled, or otherwise used are not eligible for return, refund, or exchange. Some items are not eligible for return, see below for details.

  • Order Cancellations: You may cancel any order placed as long as the order has not been shipped or in the case of liners and covers, the order has not gone into production with the manufacturer. Orders canceled after production has started or shipped will be treated as a return. Items eligible for return may incur an additional 15% to 50% restocking fee. Note: some items are not eligible for return as outlined in this document and the manufacturer policy.
  • Return Goods Authorization (RGA): All returns must be assigned a Return Goods Authorization (RGA) number. Please call 1-800-918-POOL or email [email protected] for instructions. Return packages without an RGA number will be refused.
  • Restocking and Shipping Fees: Eligible returns (for Pool Liners please refer to the specific Pool Liner policy) are subject to a restocking fee of 15% to 50% based on the sales price of the item (or up to 50% depending on the manufacturer). The customer is liable for all actual return shipping and handling fees. We highly recommend using a trackable shipping method with insurance, as we are not responsible for return packages lost or damaged in transit.
  • Vinyl Works Returns: Any return of a Vinyl Works product is subject to all applicable return authorization requirements and manufacturer policies. In addition to any applicable restocking fees, the customer is solely responsible for all costs associated with returning Vinyl Works products to the manufacturer's designated return facility in Canada. Such costs may include, but are not limited to, shipping charges, freight charges, brokerage fees, customs clearance fees, insurance, duties, taxes, tariffs, ad valorem taxes, and any other charges incurred in connection with the return shipment. PoolStore.com shall not be responsible for any costs associated with the return of Vinyl Works products.
  • International Duties, Tariffs, and Import Fees: For all orders shipped outside the United States, the customer is solely responsible for any and all duties, customs fees, brokerage fees, value-added taxes (VAT), goods and services taxes (GST), ad valorem taxes, tariffs, import fees, governmental assessments, and any other charges imposed by the destination country or any governmental authority. Such charges are not included in product pricing, shipping charges, or freight quotations unless expressly stated otherwise and must be paid by the customer. Failure to pay such charges may result in delays, refusal of delivery, return of the product, storage fees, or other costs, all of which shall be the sole responsibility of the customer.
  • Non-Returnable Items: Certain items are not returnable at all. This includes any custom items, pool liners (see pool liner policy below), sun dome, inground pool dome enclosures, above-ground screen sun dome enclosures or safety cover made to your measurements. Coverlon and Rayner Safety Covers are custom covers and cannot be exchanged or returned. Above-ground vinyl pool liners may not be returned if the box is opened and/or the liner has been removed from the box. Inflatable products are not returnable due to health concerns. Pool chemicals, fencing kits, decks, and above-ground pools are not returnable. HPI, Rayner, GLI, and Coverlon safety covers can not be returned. All pool sales are final and can not be returned (this includes above-grond, in-ground, semi in-ground, and plunge pools).
  • Specific Pool Liner Policies:
    • Liners that have been removed from the box cannot be returned unless there is a qualifying manufacturing defect.
    • Defective Liners: In the case of a qualifying manufacturer defect, a claim will be filed with the manufacturer, and the customer may be required to send the original liner back, send photographs of the failure, provide a portion of the liner with the manufacturing defect, or provide other proof to facilitate the exchange/return. In the event of a manufacturer defect, contact us immediately at 1-800-918-POOL or email [email protected] so we can work to resolve the issue. Note: PoolStore.com and manufacturers are not responsible for any costs including but not limited to pool water replacement, labor/installation service fees associated with the replacement of the defective product.
    • Swimline Liners: There is a 50% restocking fee on unopened/uninstalled Swimline Pool Liners. Standard pool liner wall heights are 48 inches, 52 inches, and 54 inches. All other wall heights are considered non-standard custom orders and are non-refundable and cannot be returned. The 50% restocking fee also applies to all Swimline liner orders that are canceled or changed after the liner production is complete. The customer is responsible for the cost of shipping the liner back. If the customer orders the wrong size, the order will be subject to a 50% restocking fee.
    • Esther Williams/Johnny Weissmuller: These pool liners are custom made and are non-returnable.
    • Pegasus Liners: These are ONLY returnable if they are in the overlap style, the package has not been opened, and the straps have not been removed (subject to a 30% restocking fee). All other Pegasus pool liners are considered custom-made and CANNOT be returned.
  • Chargebacks: Initiating a credit card dispute (chargeback) for products purchased from PoolStore.com will result in the immediate voiding of any manufacturer warranties and all return or exchange privileges.

5. Coupons and Promotional Codes From time to time, PoolStore.com may offer promotional or coupon codes for discounts on products.

  • Usage Limitations: Promo Codes cannot be combined with any other offers, discounts, or promotions (no "stacking").
  • Redemption: Promo Codes have no cash value, are not redeemable for cash, and cannot be applied to previously placed orders. Only one (1) Promo Code may be used per order.
  • Exclusions: Unless explicitly stated otherwise, Promo Codes are not applicable to items already marked on sale, shipping charges, taxes, special order/custom items, or products subject to specific manufacturer MAP (Minimum Advertised Price) policies.

6. Color, Dye Lot, and Manufacturing Discrepancy Disclaimer We make every effort to display product images, colors, finishes, and specifications as accurately as possible. However, due to the many variations in computer monitors, mobile devices, browsers, and screen calibrations, color reproduction on the internet is not precise, and we cannot guarantee that the color you see on your screen accurately portrays the exact true color of the product you will receive.

Furthermore, minor variations in color or texture frequently occur due to normal dye lot changes in materials, digital photography limitations, and standard manufacturing tolerances. Different manufacturers may also use the exact same color name to describe distinctly different actual colors.

Because PoolStore.com is a value-priced online store, we ship our products directly from the manufacturer to pass savings on to you. As a result, we do not physically inspect or see the individual product prior to shipment. By purchasing from our site, you acknowledge and agree that we are not responsible for differences in color perception, dye lot variations, or manufacturing tolerances, and we do not accept returns or issue refunds solely due to these color variances.

7. Local Ordinances, Permits, and Safety It is strictly the homeowner's responsibility to obtain all necessary town, city, county, or HOA permits prior to purchase. You must verify that the equipment ordered meets all local safety codes. PoolStore.com is not responsible for equipment that fails to meet local regulations, nor are we liable for any issues arising from ordering an incorrect size. Safety is paramount: jumping or diving into above-ground swimming pools is strictly prohibited.

8. Limitation of Liability and Indemnification

  • Indemnification: You agree to indemnify, defend, and hold PoolStore.com harmless against any claims, losses, liabilities, costs, or attorney's fees resulting from your use of the site, misuse of our products, or improper assembly.
  • Installation Delays: PoolStore.com strongly advises that you do not schedule an installation crew until you have received your entire order and inspected all items.
  • Limitation of Liability: Regardless of whether an error has been made by us or the supplier/manufacturer, we will not be responsible for any associated costs, such as pool water replacement or installation and service fees. Specifically (but not limited to), we are not responsible for pool water replacement, lost wages, hired installation labor, equipment rentals, property damage, or delays caused by shipping or backordered products. Under no circumstances shall our cumulative liability exceed the purchase price of the goods.
